We are often asked why use an attorney for your real estate transaction . Although there is some overlap between the title agent /title company and real estate attorney services, there are also distinct differences.
Your attorney is your advocate. They can provide legal advice , review, negotiate and/or draft legal documents on your behalf. A real estate attorney can help you evaluate the advisability of a real estate transaction. In addition, an attorney who is a licensed title agent can assist you in obtaining or discovering marketable title without any unacceptable or undisclosed exceptions, liens, open/expired permits or violations. Your real estate attorney can also help you avoid signing anything that is not consistent with your contract, and can help you resolve contract disputes should they arise. At Edward S. Robbins P.A., we endeavor to resolve issues before they become problems.
A title agent on the other hand need not necessarily be an attorney, and there is no requirement that a title company in Florida be associated with a real estate attorney. The title company alone cannot provide you legal advice or draft and/or negotiate legal documents on your behalf. They are not required to act as your advocate and may in fact be working for another party in the transaction. In general, it is the job of the title company simply to insure marketable title subject to the disclosed exceptions, and insure the lenders first lien position. Issues involving the condition of the property, open or expired permits and/or municipal violations are not covered by title insurance, unless a recorded lien is involved. Many of the functions of the title agent are largely ministerial in nature, a distinctly separate function from that of your real estate attorney.
